The 4 March 2009 arrest warrant against the Sudanese President Omar Al- Bashir has changed the previous enthusiastic relationship between the ICC and its biggest bloc Africa. The AU passed non-cooperation decision following the measures the ICC took against the Sudanese and Kenyan Senior State officials. This paper intended to research this tense situation between the two. Immunity of sitting heads of state and the choice between prosecutorial and transitional justice are the basic point of controversy. The universality of international law and legitimacy of international institutions are used as a theoretical lens.
